James Bond in court: The "007" and "Bond, James Bond" marks are at risk in Europe

The global commercial empire of James Bond is facing a serious legal challenge, following an application by a Dubai-based company seeking the cancellation of the relevant trademarks in the European Union and the United Kingdom. The rights holders - the American company Danjaq and the British company Eon - requested more time to prepare their defence, as iconic marks such as "007", "James Bond" and the emblematic phrase "Bond, James Bond" are being challenged.

The application is based on a critical principle of trademark law: if a mark is not genuinely used for five consecutive years, it can be cancelled. The Austrian entrepreneur Josef Kleindienst, who is developing the ambitious Heart of Europe complex off the coast of Dubai, argues that the Bond marks are not being sufficiently exploited in the market, leaving room to weaken their protection.

The argument is reinforced by the long pause in the production of a new film: Daniel Craig's last appearance was released in 2021, and since then neither the new lead actor nor the timeline for the next film has been announced. This gap creates the risk of exceeding the longest historical interval between two Bond films.

The stance of the organisations and the next steps
Danjaq has already filed its defence in the United Kingdom and requested an extension from the EUIPO, which stressed that such requests are accepted when submitted in good time. However, it clarified that no new extensions are provided beyond mid-June, except in exceptional cases.

The rights to the franchise are shared by Danjaq and MGM Studios, which were acquired by Amazon in 2021 for 8.5 billion dollars. Amazon now has creative control and the ability to proceed with new films and television spin-offs, without the prior approval of the brand's historic managers.

The next chapter for Bond
In March it was announced that the next film will be handled by producers Amy Pascal and David Heyman, two of the most powerful names in the industry. Neither the production date nor the new "007" has been announced, while the legal battle to protect the emblematic marks is in full swing.

The case is a characteristic example of how important it is for a mark to be in continuous genuine use, even when it is one of the most recognisable brands in the world.
